AG Cooper recounts TVA air pollution fight for Asheville lawyer group

A lawsuit against the Tennessee Valley Authority paid off for North Carolina despite its failure in court, N.C. Attorney General Roy Cooper said Wednesday.

The utility agreed in April to a landmark settlement that sharply cuts coal-fired power plant emissions drifting into the North Carolina mountains, Cooper told a group of more than 100 Buncombe County lawyers Wednesday. “We ended up with a wildly successful result,” he said at the monthly lunch meeting of the 28th Judicial District Bar. ...

Cooper, in April, entered into the settlement agreement with TVA, EPA and several states and environmental groups that required the utility to shutter operations that account for about 16 percent of its coal-fired generation capacity. In return, Cooper agreed to withdraw his Supreme Court petition. ...

He also said he plans to seek a fourth term as attorney general in 2012. ...
