Today, Sept. 6, Xpress and the other media outlets involved in an open records lawsuit against the Buncombe County District Attorney's office and the city of Asheville received word that Judge Bradley Letts had dismissed their push for the release of an audit of the Asheville Police Department evidence room.
So far, there's no written ruling or order from Letts offering a justification for his decision. He also denied the city of Asheville's request that he require the alliance of local media to pay their attorney's fees. Attorneys for both sides made their arguments before Letts Tuesday morning, Sept. 4.
The lawsuit contended that the audit was a public record, and District Attorney Ron Moore's refusal to release it a violation of the state's open records laws. The city and DA's representatives asserted that since information in the documents could be related to current and future criminal investigations, it is not a public record.
