APD cites business owner for gambling operation

ASHEVILLE – On 08-24-11 at approx. 1630 hours, the Asheville Police Department Vice Unit, along with West District Community Resource Officers, responded to Color TV and Appliance located at 507 Haywood Rd., Asheville, NC 28806 to cite the owner for operating an illegal gambling operation out of the business.
Acting on complaints from the community, vice officers had conducted undercover operations at this location and determined that gaming machines were being utilized to pay out cash winnings in violation of NC G.S. 306.4(a)(1).
The owner of the machines, (Kenneth Palmer Shealy, W/M, 12-18-60; of 67 Elson Ave., Hendersonville, NC) was cited for Possession and Operation of Electronic Gaming Devices.
The six stand alone gaming machines were seized along with $1,187 dollars from the machines and a separate $89.00 dollars that was recovered from payout of winnings.
Mr. Shealy’s court date in this matter is October 06, 2011.
