In 2007 shooting case, Appeals Court allows lawsuit against Asheville police to go forward
FROM THE ASHEVILLE CITIZEN-TIMES:

The N.C. Court of Appeals ruled a woman who was shot while riding as a passenger during a car chase can move forward with her lawsuit against city officers who shot at the vehicle several times.

Mary Ann Wilcox was hit by two bullets and suffered injuries to her liver, leg and spleen during a police on a chase on May 31, 2007.

She was riding with Larry Julius Wilson, the driver who led officers on a police chase of about 20 minutes.

Wilcox originally filed a lawsuit in Buncombe County Superior Court against the city of Asheville, former Police Chief William Hogan and three officers — Stony Gonce, Brian Hogan and Cheryl Intveld — in their official and individual capacities.

The Appeals Court upheld the original decision, declining to dismiss the claims against the officers on grounds of public official immunity in their individual capacities. ...
